The life insurance company doesn’t really want to decide who should get paid. The life insurance company wants to follow written instructions – the “Beneficiary Designation” or the paragraphs of the life insurance policy that have an order of payment. Sometimes, if a beneficiary is designated, but then themselves dies, the life insurance company may want to pay the beneficiary’s heirs – who may not be the same as other people more closely related to person with the life insurance who just died.
We have seen cases with multiple Beneficiary Designations, sometimes with portions to various people. It is a factual question, not opinion, whether the life insurance company actually received the various designations.
If the life insurance policy has disputes between possible beneficiaries, sometimes the life insurance company will sue everyone in an Interpleader action. This puts the life insurance policy benefits into the hands of a Judge, often a United States District Court Federal Court Judge. This is a regular lawsuit, but in Federal Court. Many lawyers are unfamiliar with Federal Court, which has its own rules. This can get complicated, very quickly.
